TERMS AND CONDITIONS
1. Introduction
1.1. These Terms and Conditions regulate the sale, including registration, through the website www.minimu.pt
1.2. The website www.minimu.pt is managed by Dias & Filipe, Lda with NIF 518567567 and registered office at Rua Henrique Sales no. 29A, 2500-213 Caldas da Rainha
1.3. For the purposes of these Terms and Conditions, the following definitions apply:
a) “Minimu” – The owner of the website and online store accessible through www.minimu.pt;
“User” – Any individual, not a trader, who places an order through the website www.minimu.pt;
1.4. The use of the website www.minimu.pt and the purchase of products on www.minimu.pt presupposes knowledge, understanding and acceptance of these Terms and Conditions by the User.
2. Registration on the website
2.1. To place an order, the User may register in advance by filling in the fields on the form available on the website www.minimu.pt
2.2. From the moment you access your personal account, the User is subject to these Terms and Conditions.
3. The products
3.1. The website www.minimu.pt is aimed at all users who wish to purchase its products, from anywhere, 24 hours a day, 7 days a week.
3.2. Information on product characteristics can be found at www.minimu.pt
3.3. Minimu reserves the right to modify, at any time, the information, product offering, prices, promotions and commercial conditions presented on the website www.minimu.pt.
4. Placing orders on the website
4.1. To purchase from www.minimu.pt , the user must have an email account and their browser must be configured to accept cookies and pop-ups, which will allow better navigation in the Minimu online store.
4.2 . The User may purchase products online, for which it is necessary that:
a) Find the product(s) you want to purchase;
b) Add the selected product(s) to the “Shopping Cart”;
c) Enter the User's personal data, which will be integrated into the Minimu database, under the terms set out in the Privacy Policy;
d) Review your order and confirm the order.
4.3 . The user will receive an order confirmation email c with the details regarding the “Payment Method” you selected.
4.4. Once payment has been made, the user will receive a new email confirming payment.
4.5. Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process.
4.6. By submitting the order form, the User accepts the Terms and Conditions of purchase described at www.minimu.pt, as well as the Privacy Policy.
4.7. Minimu reserves the right not to accept and cancel orders already confirmed in the following situations:
a) The product is not available;
b) Payment is not made using any of the payment options available on the website www.minimu.pt ;
c) Payment is not confirmed;
d) The billing information is not correct or verifiable;
e) There is an error in the price quote;
f) It is not possible to deliver to the address indicated by the User.
5. Prices
5.1 The prices of the products displayed on this page include the Portuguese Value Added Tax (VAT) in force.
5.2. Prices are quoted in euros. (€).
5.3. The prices of the products presented are subject to change. Minimu reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
5.4. If there is an error in the price of the products requested, Minimu or the user may, up until the order is shipped, cancel the order.
6. Payment methods
6.1. The User may pay for their purchases using a debit/credit card, MBWAY, Multibanco reference and PayPal.
7. Shipping costs
7.1. Shipping costs are free for mainland Portugal and the islands.
Outside of Europe, all orders will have an associated shipping cost, which may require the payment of customs costs, depending on the country of delivery.
8. Deliveries and shipping
8.1. Purchases made on www.minimu.pt are limited territorially to Portugal and other European countries.
8.2. Our delivery service does not include a scheduling option, so the order will be delivered without prior contact from the carrier, and it is necessary to ensure that someone is at the delivery address.
8.3. Minimu delivers to mainland Portugal, Madeira and the Azores, as well as other countries in the European Union.
Delivery times vary between:
- Mainland Portugal: 2-5 working days;
- Islands (Madeira and Azores): 5-10 working days;
- Rest of the EU countries: 7-15 working days.
8.4. Minimu will send the product(s) ordered by the user, from Monday to Friday, from 9 am to 3 pm, except on holidays, according to the times previously scheduled with the contracted carrier, to the delivery address indicated by the User.
Minimu's ability to respond within the aforementioned deadlines varies depending on stock availability, as well as during promotional, sales and Christmas periods.
8.5. If the carrier is unavailable to deliver the products on the date indicated, the user will be contacted to provide another delivery date or the product will be left at a Pick-Up point.
8.6. Upon delivery, the user must inspect the packaging to check for any damage. If the products are found to be damaged, the user must not accept delivery of the order, which will be returned. The user must report the situation, documented with photographs if possible, via email to @minimu.pt and if the user agrees, Minimu will resend the product, at no cost to the user.
8.7. If you do not receive your order within a maximum period of 60 (sixty) days from the date of payment for the order, please send an email to @minimu.pt informing us of what happened. After this period, Minimu cannot be held responsible for the loss of the order.
9. Validity of promotions
9.1. Offers on the website are valid only for the time they are displayed on the website, unless otherwise stated on the website.
10. Right to free resolution
10.1 The User may terminate the contract up to 14 (fourteen) days after receiving the order, provided that:
- The product(s) have not been used;
- The product(s) maintain their original characteristics, without any trace of use or alteration, and keep the original packaging and labels intact and undamaged;
- The product(s) are complete. All material accompanying the order must be returned.
10.2. The user can exercise their right to free resolution by sending an email to @minimu.pt or through their customer account.
10.3. The costs of returning the order when exercising the right of free withdrawal are borne by the user.
10.4. Once the returned product has been received, Minimu will analyze and confirm the condition of the order and, when applicable, will refund the amounts paid by the User as stated in the order within a maximum period of 10 (ten) days, using the same payment method used for the purchase.
Exchanges??
11. Quality
Minimu does not sell second-hand products, products with defects or products of inferior quality to those available on the market.
Minimu will make every effort to ensure that the colours of products appearing on the website are as accurate and realistic as possible. However, as computer monitors vary, we cannot guarantee that your monitor will display the exact colours.
12. Complaints
With the aim of continuously improving the services provided, Minimu will seek to respond to and resolve complaints submitted by the User within 5 (five) business days, via email @minimu.pt
13. Exclusion and limitation of liability
Minimu does not guarantee the uninterrupted operation of the website www.minimu.pt, or any of its functionalities, and it may be suspended to carry out maintenance, repair or updates.
Minimu will not assume, in the same way, any responsibility for any damages, arising, directly or indirectly, from situations of force majeure that prevent Minimu, in any way, from fulfilling its obligations, namely, strikes, failures in the electricity grid, in telecommunications services or in any other services, fires, floods, impossibility of obtaining products, materials or services, breakdowns, delays by suppliers or carriers and changes in legislation or administrative regulations.
Minimu is not responsible for any abusive use of the User's access data to the website by third parties, as they are personal and non-transferable.
14. Modification of terms and conditions
Minimu reserves the right to change these Terms and Conditions at any time, considering the changes made and users notified by publishing the modified Terms and Conditions on the website www.minimu.pt.
15. Processing of personal data
We ask that you read our Privacy Policy carefully so that you can be aware of the rules and procedures adopted by Minimu regarding the processing of data collected when you browse the website www.minimu.pt and when you use the features it offers, as well as the applicable security and confidentiality measures.
16. Evidence and archive
The computer records obtained by Minimu are considered as proof of communications, orders and payments made between Minimu and the user.
17. Applicable law
These Terms and Conditions and all disputes arising in connection with them are subject to Portuguese law.
